Welcome to NewSay Live, operated by EnglishWing ("we", "us", or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App. Consider this our Calling Card.
1. Description of Service
NewSay Live is an immersive, multi-language learning application. We provide educational content spanning several languages (including English, Spanish, French, German, Korean, Japanese, and Chinese). The journey is structured as Main Quests (city exploration) and Side Quests (Petal of Time, news reading, vocabulary cards). The App also features advanced AI Pet Tutors for simulated conversation practice.
2. Local Progress & Rules of Rebellion
Your journey is your own. You do not need to create an account to start playing or to save your progress. To ensure the best experience, you agree to:
- Local Storage: Understand that your learning progress, streaks, and Pet status are stored securely on your local device. Deleting the App or clearing its data may result in the permanent loss of this data. We cannot restore local data if it is deleted.
- Cloud Syncing: Acknowledge that while core progress is local, your AI Pet Tutor chat logs are securely synced to our servers (MongoDB) using a randomized ID to maintain the context and memory of your conversations.
- Fair Play: Not use automated scripts or bots to artificially inflate your learning hours, streaks, or Grammar Slash game scores.
3. Freemium Model & Subscriptions
NewSay Live operates on a freemium model. Your access is subject to the following:
- Free Tier: Start your journey at no cost. Some features, such as access to new languages, AI Cat Tutor interactions, custom UI skins, and companion cat slots, may be limited.
- Premium Subscriptions: You may purchase auto-renewing subscriptions (Monthly or Yearly) to unlock the ultimate experience. No account creation is necessary; your premium status is securely tied directly to your Apple App Store or Google Play Store ID.
- Billing: Payments are processed via your device's native app store account (managed via RevenueCat). Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
- Cancellations: You can manage or cancel your subscription directly in your device's App Store settings. We do not process refunds directly; please refer to your respective App Store's refund policy.
4. The AI Pet Tutor & Content Guidelines
Our AI Pet Tutor utilizes third-party APIs (Google Gemini and OpenAI) to provide dynamic, roleplay-based conversational practice. By using this feature, you acknowledge:
- AI Limitations: The AI may occasionally produce inaccurate, unexpected, or grammatically imperfect responses. It is a learning tool, not a human instructor.
- Prohibited Prompts: You agree not to input prompts that are explicit, violent, discriminatory, or intended to bypass the AI's safety filters. Violating this may result in an immediate restriction of your access to the AI features.
- Data Usage: Your text prompts are processed by our AI partners to generate responses, but are not used to train their public models. (See our Privacy Policy).
5. Intellectual Property
All content within NewSay Live—including but not limited to the 3D cat models, city exploration, Cat videos, Office Dialogue videos, character sprites, UI/UX designs, and code—is the intellectual property of EnglishWing or properly licensed to us.
You may not copy, modify, distribute, sell, or lease any part of our App. You may, however, share clips of your gameplay from the "Reels" section directly to social media using the provided in-app sharing tools.
6. Termination
We reserve the right to suspend or terminate your access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms of Service or is harmful to us, other users, or third parties.
7. Limitation of Liability
To the maximum extent permitted by law, EnglishWing shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your access to or use of, or inability to access or use, the App.
8. Changes to Terms
We may modify these Terms at any time as our features evolve. We will notify you of any material changes by updating the "Last updated" date and displaying a notice within the App. Continued use of the App after changes means you accept the new terms.
